1. Acceptance of Terms

By accessing or using the Ithaca platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Ithaca.

2. Description of Service

Ithaca is an AI-powered educational and informational tool designed to assist users with understanding Canadian immigration processes, calculating Comprehensive Ranking System (CRS) scores, organizing application documents, and connecting with licensed immigration consultants.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years of age to use the Service.
• You may not create multiple accounts or share account access with others.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Responsibilities

When using the Service, you agree to:

• Provide truthful and accurate information in your immigration profile.
• Not use the Service for any unlawful purpose or to facilitate immigration fraud.
• Not attempt to reverse-engineer, decompile, or extract source code from the Service.
• Not use automated tools (bots, scrapers) to access the Service without authorization.
• Not upload malicious files, viruses, or harmful content.
• Verify all information provided by the AI with official IRCC sources before relying on it.

5. AI-Generated Content

The AI assistant provides information based on publicly available immigration data and your profile. While we strive for accuracy:

• AI-generated content may contain errors or outdated information.
• CRS scores and immigration assessments are estimates and may differ from official IRCC calculations.
• AI responses do not constitute legal advice or guaranteed outcomes.
• You retain the right to review, edit, lock, or delete any facts the AI extracts from your conversations.
• We are not liable for decisions made based on AI-generated content.

6. Consultant Services

Ithaca provides a platform for connecting users with licensed immigration consultants. Regarding consultant interactions:

• Ithaca does not employ, endorse, or guarantee the services of any consultant listed on the platform.
• Consultant-client relationships are independent of Ithaca.
• You control what data is shared with consultants through granular sharing settings (full, limited, or blocked access).
• Consultants are bound by their own professional obligations under the College of Immigration and Citizenship Consultants (CICC).

7. Subscriptions & Payments

• Certain features require a paid subscription or credit purchase.
• Payments are processed securely through Stripe. We do not store your payment card details.
• Subscription plans auto-renew unless cancelled before the renewal date.
• Refunds are handled on a case-by-case basis. Contact [email protected] for refund requests.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

8. Intellectual Property

The Service, including its design, code, AI models, content, and branding, is owned by Ithaca and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

You retain ownership of all personal data and content you upload to the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

9. Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms. Key protections include:

• Right to export all your data in machine-readable format (free of charge)
• Right to delete your account and all associated data at any time
• Granular consent controls for data processing, analytics, and AI profiling
• Encryption of sensitive personal information

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee the accuracy, completeness, or timeliness of immigration information.
• We are not liable for any immigration application outcomes, visa denials, or delays.
• Our total liability to you shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
• We are not liable for indirect, incidental, special, or consequential damages.

11. Termination

You may terminate your account at any time through Account Settings. We may suspend or terminate your access if you violate these Terms. Upon termination:

• Your right to use the Service ceases immediately.
• We will delete your personal data in accordance with our Privacy Policy and data retention schedule.
• You may export your data before deletion using the free JSON export feature.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be resolved in the courts of Ontario, Canada, unless otherwise required by applicable consumer protection laws in your jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
